A boutique law firm in Tel Aviv, practising civil and commercial litigation, with a particular expertise in two fields: professional negligence claims against lawyers, and fee disputes between lawyers and their clients.
Adv. Eli Halm was admitted to the Israel Bar in 1999. He is the author of Professional Negligence of Lawyers, published by the Israel Bar Publishing House in 2017, and of Privacy Protection Law, published by Perlstein Ginossar in 2003. He studied law at the University of Haifa and at Reichman University.
The firm is deliberately small. We take on a limited number of matters, and every case is handled personally by the lawyer who knows it. Alongside Adv. Halm the firm includes Adv. Yonatan Levi, Adv. Udi Sadan and Adv. Idan Moldavsky.
We act on both sides of this field. We bring claims on behalf of clients who have been harmed by their own lawyer, and we defend lawyers who have been sued, together with their professional indemnity insurers.
A claim of this kind is rarely simple. It requires proof not only that the lawyer fell below the standard of care, but that the failure caused a loss, which in practice means reconstructing the original case and asking what would have happened had the lawyer acted properly. Israeli law calls this a trial within a trial.
We handle disputes between clients and their lawyers over fees: excessive fees, the absence of a written engagement, the setting of a reasonable fee, cancellation of a fee agreement, and claims for repayment of sums already paid.
We represent companies and individuals before the courts in breach of contract, monetary claims and real property matters, from the Magistrates Court to the Supreme Court.
Professional Negligence of Lawyers is the comprehensive Israeli work on the subject. It sets out the lawyer's duty of care and the standards drawn from the case law, the acts and omissions that give rise to liability in each area of practice, the doctrines of the trial within a trial and of loss of a chance, the duties owed to persons who are not clients, the liability of office holders, and professional indemnity insurance. The book is listed in the catalogue of the National Library of Israel and in the store of the Israel Bar Publishing House.
